AN ORDINANCE GRANTING CONDITIONAL USE PERMIT NUMBER CU-10-267 FOR THE HEREINAFTER DESCRIBED PROPERTY FOR THE PURPOSE OF OPERATING AN AMUSEMENT ARCADE ON A SITE ZONED R9 MIXED USE WITH PROFFERS. This ordinance granted a conditional use permit that allowed the operation of an amusement arcade located at CNU Village, 12368 Warwick Boulevard, Suites 104 and 105, on a 4.65 acre parcel and zoned R9 Mixed-Use District. The amusement arcade portion of the business would allow customers to pre-pay for extended periods of play time on assorted commercial computer and video game systems. The proposed hours of operation were consistent to those within CNU Village. No food services would be allowed on the premises. Parking for the use could be accommodated on site. On February 3, 2010, the Planning Commission voted unanimously (8:0) to recommend approval of the request with amended conditions. The City Manager recommended approval.

2. Zoning Text Amendment - ZT-10-282, City of Newport News, Amending Regulations for the Neotraditional Overlay District
AN ORDINANCE TO AMEND AND REORDAIN CHAPTER 45, ZONING ORDINANCE, OF THE CODE OF THE CITY OF NEWPORT NEWS, VIRGINIA, ARTICLE XXXI., OVERLAY ZONING DISTRICTS AND REGULATIONS, DIVISION 7., NEOTRADITIONAL DEVELOPMENT PROPOSALS; MODIFICATION OF DEVELOPMENT REGULATIONS. This ordinance amended the City Code, Chapter 45, Zoning Ordinance, Section 45-3152 neotraditional Overlay District, which reduced the acreage requirement of neotraditional developments from no less than 100 acres to no less than 50 acres. Future neotraditional developments would mainly be redevelopment sites that may not be able to meet the 100-acre requirement. Fifty acres was an appropriate size for quality mixed-use developments. On February 3, 2010, the Planning Commission voted unanimously (8:0) to recommend to City Council the adoption of the amendment. The City Manager recommended approval.

3. Ordinance Adding Chapter 40, Taxation, Section 40-8.09 for Real Property Tax Exemption - Orcutt Senior Housing, L.P.
AN ORDINANCE TO AMEND AND REORDAIN CHAPTER 40, TAXATION, OF THE CODE OF THE CITY OF NEWPORT NEWS, VIRGINIA, ARTICLE I., GENERAL PROVISIONS AND EXEMPTIONS, DIVISION 3., PROPERTY EXEMPTED BY DESIGNATION, BY ADDING THERETO A NEW SECTION, NAMELY: SECTION 40-8 .09, PROPERTY OF ORCUTT SENIOR HOUSING, L.P. This ordinance added Section 40-8.09, to the City Code, Chapter 40, Taxation, for the property of Orcutt Senior Housing, L.P. At its October 27, 2009 Regular Meeting, City Council authorized the creation of the Orcutt Townhomes III Limited Partnership and the Orcutt Townhomes Phase III Development Corporation by the Newport News Redevelopment and Housing Authority (NNRHA). Orcutt III was the final replacement phase by the NNRHA of the former Orcutt Public Housing Project. It was being constructed using Low-Income Housing Tax Credits (LIHTC) and Federal Capital Grant (Public Housing) funds. The required mixed finance applications were prepared by NNRHA and were under final review by HUD. One of the prerequisites of HUD’s approval of the mixed finance package was confirmation that the Orcutt III complex be exempt from the payment of real estate taxes. The NNRHA requested that the property be made exempt from taxation by designation pursuant to City Code, Chapter 40, Section 40-8. This was one of three companion items. The City Manager recommended approval.

1. Ordinance Amending City Code Chapter 39, Swimming Pools, Section 39-28 Lifeguards, Related to Navy Housing Complex (TCF)
AN ORDINANCE TO AMEND AND REORDAIN CHAPTER 39, SWIMMING POOLS, OF THE CODE OF THE CITY OF NEWPORT NEWS, VIRGINIA, ARTICLE II., PUBLIC POOLS, DIVISION 1., GENERALLY, SECTION 39-28, LIFEGUARDS. This ordinance amended the City Code, Chapter 39, Swimming Pools, Section 39-28: Lifeguards, to add gated housing complexes whose residents were primarily limited to unaccompanied military personnel to those developments already exempted from the full-time lifeguard requirement. Chapter 39, Section 39-28 of the City Code exempted the requirement at public pools owned by a homeowners’ association, recreation association, health club or condominium, if other specific criteria was met. The exemptions excluded the Navy Housing Complex located between Washington and Huntington Avenues, from 30th to 32nd Streets. Exempting pools operated within a gated housing complex whose residents were primarily limited to unaccompanied military personnel would include the Navy Housing Complex, as long as all other criteria had been met. The Acting City Manager recommended approval.

2. Ordinance Accepting Streets and Public Improvements on Magistrate Lane and Parliament Lane in Courthouse Green into the City System
AN ORDINANCE TO ACCEPT MAGISTRATE LANE AND PARLIAMENT LANE, COURTHOUSE GREEN SUBDIVISION, AND THE PHYSICAL IMPROVEMENTS CONTAINED THEREIN AND THEREON INTO THE CITY STREET SYSTEM. This ordinance accepted the streets and public improvements on Magistrate Lane and Parliament Lane in Courthouse Green into the City system. A final inspection was made of the streets known as Magistrate Lane and Parliament Lane. The inspection indicated compliance with all requirements. Once accepted, the streets which were constructed at the developer’s expense would be eligible for state maintenance payments. The City Manager recommended approval.

4. Resolution Authorizing the City Manager to Execute the Virginia Marine Resources Commission (VMRC) Permit No. 09-1717 for Rehabilitation Work to Walkers Dam
A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST, ON BEHALF OF THE CITY OF NEWPORT NEWS, VIRGINIA, THAT CERTAIN COMMONWEALTH OF VIRGINIA, MARINE RESOURCES COMMISSION PERMIT NO. 09-1717 AND ANY RELATED DOCUMENTS PERTAINING TO OR PERMITTING THE ENCROACHMENT IN, ON, OR OVER STATE-OWNED SUBAQUEOUS BOTTOMS RELATED TO WALERS DAM PURSUANT TO THE CODE OF VIRGINIA, 1950, AS AMENDED. This resolution authorized the City Manager to execute the Virginia Marine Resources Commission (VMRC) Permit No. 09-1717 which authorized rehabilitation work to Walkers Dam in New Kent and Charles City Counties. This permit authorized rehabilitee of the sheetpile dam and abutments with new steel sheeting and concrete work. It also authorized replacement and relocation of the former fish ladder, re placement of the manual boat lock structure and placement of riprap scour protection to facilitate repairs to the dam. This rehabilitation project was considered Phase II of the long-term improvements to Walkers Dam, which suffered a dam breach in April 2007. This resolution authorized the City Manager to execute VMRC Permit No. 09-1717. It further authorized the City Manager, or his designee, to execute further VMRC permits after review by the City Attorney’s Office. The City Manager recommended approval.

G. Appropriations
1. Newport News Redevelopment and Housing Authority (NNRHA) - FY 2010 HOME Program Grant - $100,000
A RESOLUTION APPROPRIATING FUNDS FROM LOCAL GRANT MATCH ($100,000.00) TO HOME GRANT ($100,000.00). This resolution appropriated $100,000.00 from the Local Grant Match portion of the City’s FY 2010 Operating Budget for the FY2020 Federal HOME Grant Program administered by the NNRHA. The annual Federal HOME Grant Program (Home Investment Partnerships Program) provided funded under an entitlement formula to cities, urban counties, and state governments to undertake housing rehabilitation and tenant-based assistance for lower-income persons. The Department of Housing and Urban Development (HUD) required localities that used HOME funds to provide a matching amount equal to 25% of their allocation. These grant funds would be used to supplement the revolving construction account being used to complete new homes in the Southeast Community. This $100,000.00 was budgeted for and reserved for this grant. No other local funds were required. No future financial or operational responsibilities were required for this grant. The City Manager recommended approval.
2. Newport News Fire Department (NNFD) - 2007 State Homeland Security Program Grant - Citizen Alerting System: $50,000
A RESOLUTION APPROPRIATING FUNDS FROM F-DHS-CIT ALERT SYSTEM-10 ($50,000.00) TO INFO TECH EQUIP OTHER ($50,000.00). This resolution appropriated $50,000.00 from Federal Grant Revenue to the Newport News Fire Department (NNFD). The City submitted a proposal to the Virginia Department of Emergency Management for funding from the 2007 State Homeland Security Program Grant to upgrade the Citizen Alerting System. The NNFD’s Citizen Alerting System would not be supported by the Vendor after December 31, 2010. The City received notice that the proposal was approved and the project budget of $50,000.00 awarded. This grant did not require a local match. The City Manager recommended approval.
3. Newport News Fire Department (NNFD) - Federal Emergency Management Agency (FEMA) and the Department of Homeland Security (DHS) - FY 2009 Assistance to Firefighters Grant: $96,200
A RESOLUTION APPROPRIATING FUNDS FROM L-ASSIS TO FIREFIGHTERS-10 ($19,240.00) AND F-ASSIS TO FIREFIGHTERS-10 ($76,960.00) TO EQUIPMENT & MACHINERY ($96,200.00). This resolution appropriated $76,960.00 in Federal Funds and $19,240.00 in local matching funds to the Newport News Fire Department (NNFD). The City submitted a funding proposal to the Federal Emergency Management Agency to support the acquisition of equipment to clean and dry their protective clothing. The Department received notice that the proposal and project budget of $96,200.00 were approved. The federal share of $76,960 was 80% of the grant. A local share of $19,240.00 was required. The City Manager recommended approval.

1. Ordinance Amending City Code Chapter 39, Swimming Pools, Section 39-28 Lifeguards, Related to Navy Housing Complex (TCF)
AN ORDINANCE TO AMEND AND REORDAIN CHAPTER 39, SWIMMING POOLS, OF THE CODE OF THE CITY OF NEWPORT NEWS, VIRGINIA, ARTICLE II., PUBLIC POOLS, DIVISION 1., GENERALLY, SECTION 39-28, LIFEGUARDS. This ordinance amended the City Code, Chapter 39, Swimming Pools, Section 39-28: Lifeguards, to add gated housing complexes whose residents were primarily limited to unaccompanied military personnel to those developments already exempted from the full-time lifeguard requirement. Chapter 39, Section 39-28 of the City Code exempted the requirement at public pools owned by a homeowners’ association, recreation association, health club or condominium, if other specific criteria was met. The exemptions excluded the Navy Housing Complex located between Washington and Huntington Avenues, from 30th to 32nd Streets. Exempting pools operated within a gated housing complex whose residents were primarily limited to unaccompanied military personnel would include the Navy Housing Complex, as long as all other criteria had been met. The Acting City Manager recommended approval.

2. Ordinance Accepting Streets and Public Improvements on Magistrate Lane and Parliament Lane in Courthouse Green into the City System
AN ORDINANCE TO ACCEPT MAGISTRATE LANE AND PARLIAMENT LANE, COURTHOUSE GREEN SUBDIVISION, AND THE PHYSICAL IMPROVEMENTS CONTAINED THEREIN AND THEREON INTO THE CITY STREET SYSTEM. This ordinance accepted the streets and public improvements on Magistrate Lane and Parliament Lane in Courthouse Green into the City system. A final inspection was made of the streets known as Magistrate Lane and Parliament Lane. The inspection indicated compliance with all requirements. Once accepted, the streets which were constructed at the developer’s expense would be eligible for state maintenance payments. The City Manager recommended approval.

This ordinance accepted the streets and public improvements on T.S. Eliot Street, Mark Twain North, Mark Twain South, Philip Roth Street, Edith Wharton Square and Eugene O’Neil Street in Port Warwick into the City system. 4. Resolution Authorizing the City Manager to Execute the Virginia Marine Resources Commission (VMRC) Permit No. 09-1717 for Rehabilitation Work to Walkers Dam
A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST, ON BEHALF OF THE CITY OF NEWPORT NEWS, VIRGINIA, THAT CERTAIN COMMONWEALTH OF VIRGINIA, MARINE RESOURCES COMMISSION PERMIT NO. 09-1717 AND ANY RELATED DOCUMENTS PERTAINING TO OR PERMITTING THE ENCROACHMENT IN, ON, OR OVER STATE-OWNED SUBAQUEOUS BOTTOMS RELATED TO WALERS DAM PURSUANT TO THE CODE OF VIRGINIA, 1950, AS AMENDED. This resolution authorized the City Manager to execute the Virginia Marine Resources Commission (VMRC) Permit No. 09-1717 which authorized rehabilitation work to Walkers Dam in New Kent and Charles City Counties. This permit authorized rehabilitee of the sheetpile dam and abutments with new steel sheeting and concrete work. It also authorized replacement and relocation of the former fish ladder, re placement of the manual boat lock structure and placement of riprap scour protection to facilitate repairs to the dam. This rehabilitation project was considered Phase II of the long-term improvements to Walkers Dam, which suffered a dam breach in April 2007. This resolution authorized the City Manager to execute VMRC Permit No. 09-1717. It further authorized the City Manager, or his designee, to execute further VMRC permits after review by the City Attorney’s Office. The City Manager recommended approval.

G. Appropriations
1. Newport News Redevelopment and Housing Authority (NNRHA) - FY 2010 HOME Program Grant - $100,000
A RESOLUTION APPROPRIATING FUNDS FROM LOCAL GRANT MATCH ($100,000.00) TO HOME GRANT ($100,000.00). This resolution appropriated $100,000.00 from the Local Grant Match portion of the City’s FY 2010 Operating Budget for the FY2020 Federal HOME Grant Program administered by the NNRHA. The annual Federal HOME Grant Program (Home Investment Partnerships Program) provided funded under an entitlement formula to cities, urban counties, and state governments to undertake housing rehabilitation and tenant-based assistance for lower-income persons. The Department of Housing and Urban Development (HUD) required localities that used HOME funds to provide a matching amount equal to 25% of their allocation. These grant funds would be used to supplement the revolving construction account being used to complete new homes in the Southeast Community. This $100,000.00 was budgeted for and reserved for this grant. No other local funds were required. No future financial or operational responsibilities were required for this grant. The City Manager recommended approval.
2. Newport News Fire Department (NNFD) - 2007 State Homeland Security Program Grant - Citizen Alerting System: $50,000
A RESOLUTION APPROPRIATING FUNDS FROM F-DHS-CIT ALERT SYSTEM-10 ($50,000.00) TO INFO TECH EQUIP OTHER ($50,000.00). This resolution appropriated $50,000.00 from Federal Grant Revenue to the Newport News Fire Department (NNFD). The City submitted a proposal to the Virginia Department of Emergency Management for funding from the 2007 State Homeland Security Program Grant to upgrade the Citizen Alerting System. The NNFD’s Citizen Alerting System would not be supported by the Vendor after December 31, 2010. The City received notice that the proposal was approved and the project budget of $50,000.00 awarded. This grant did not require a local match. The City Manager recommended approval.
3. Newport News Fire Department (NNFD) - Federal Emergency Management Agency (FEMA) and the Department of Homeland Security (DHS) - FY 2009 Assistance to Firefighters Grant: $96,200
A RESOLUTION APPROPRIATING FUNDS FROM L-ASSIS TO FIREFIGHTERS-10 ($19,240.00) AND F-ASSIS TO FIREFIGHTERS-10 ($76,960.00) TO EQUIPMENT & MACHINERY ($96,200.00). This resolution appropriated $76,960.00 in Federal Funds and $19,240.00 in local matching funds to the Newport News Fire Department (NNFD). The City submitted a funding proposal to the Federal Emergency Management Agency to support the acquisition of equipment to clean and dry their protective clothing. The Department received notice that the proposal and project budget of $96,200.00 were approved. The federal share of $76,960 was 80% of the grant. A local share of $19,240.00 was required. The City Manager recommended approval.
